TERMS AND CONDITIONS

THESE RULES GOVERN YOUR SUBMISSION TO GENERAL MEDIA COMMUNCIATIONS, INC. ("GMCI") A SUBSIDIARY OF THE PENTHOUSE MEDIA GROUP, INC. ("PMGI"):

1) By submitting photos, digital images, and/or videos ("Media") you represent that both you and whoever owns the copyright in the image (photographer) are the rightful owners and will transmit to us an executed Model Release and Agreement and Copyright Assignment.

2) You may submit as many Media sets as you wish, but each must be accompanied by a complete set of the paperwork listed above. All entries will become the property of The GMCI; none will be returned.

3) Both the Model and copyright owner represent and warrant that the transmitted Media have never been published anywhere; that all rights are being conveyed to GMCI, and that the publication and dissemination of the pictures in any medium for any purpose will not violate any rights of any person, firm or entity.

4) PMGI is under no obligation to use any photographs submitted.

5) You represent and warrant that you are the person depicted in the images and that at the time the images were taken, you were at least 18 years of age, at least 19 if a resident of Alabama, Nebraska, or Wyoming, and  21 if a resident of Mississippi or Puerto Rico.

6) By submitting Media both model and copyright owner authorize GMCI to use them in all media, including, but not limited to: PMGI magazines PENTHOUSE, FORUM, VARIATIONS, PENTHOUSE LETTERS and GIRLS OF PENTHOUSE; on the PENTHOUSE.COM website and any other of our websites; in videos, produced by PMGI or by others; for commercial use, for advertising and promotion of our products and those of our advertisers and sponsors.

7) Submissions will also be considered for photography as a PENTHOUSE PET OF THE MONTH or PET OF THE YEAR. You may also be entered in an online contest at a PMGI website in which subscribers will be asked to vote for the girl of the day, week and month.

8) If we use your photograph you will be compensated according to our standard rates for such usages. Our fee to the photographer is a one-time fee for all subsequent uses in any and all media any number of times. Our fee to the model in any medium is based on the medium of first use. That means that if we post your picture to the web site, your fee covers that use and all future uses, in all media, anywhere.  If you are first published in a magazine, that fee covers all future uses in all media, anyway. You understand that our fee schedule for amateur models is not the same as for professionals. If you are selected for consideration for a feature photographic layout (as a FEATURE GIRL,  PET OF THE MONTH or PET OF THE YEAR) we will make separate arrangements with you.

9) If you are transmitting images of actual, not simulated, sexually explicit conduct (masturbation, genital-genital, genital-oral, genital-anal or oral-anal) intercourse or sadistic or masochistic abuse) the photographer MUST comply with the section of the Copyright Assignment titled "RECORD-KEEPING ACT COMPLIANCE" and must make sure that EACH image sent to us contains the "Label".
